Regulation 3 Sharing of information by the Authority

(1) Core biometric information collected by the Authority under the Act shall not be shared with anyone for any reason whatsoever.

(2) The demographic information and photograph of an individual collected by the Authority under the Act may be shared by the Authority with a requesting entity in response to an authentication request for e-KYC data pertaining to such individual, upon the requesting entity obtaining consent from the Aadhaar number holder for the authentication process, in accordance with the provisions of the Act and the Aadhaar (Authentication and Offline Verification) Regulations, 2021.

(3) The Authority shall share authentication records of the Aadhaar number holder with him in accordance with regulation 28 of the Aadhaar (Authentication and Offline Verification) Regulations, 2021.

(4) The Authority may share demographic information and photograph, and the authentication records of an Aadhaar number holder when required to do so in accordance with Section 33 of the Act. [(5) The Authority may, for omitting or deactivating an Aadhaar number and information relating thereto, pursuant to an inquiry as referred to in sub-regulation (1) of regulation 29 of the Aadhaar (Enrolment and Update) Regulations, 2016, give access to or use or disclose information of the Aadhaar number holder, in its possession or control, including information stored in the CIDR, in accordance with sub-regulation (1A) of regulation 29 of the said regulations.] [(6) The Authority may, with the consent of parent or guardian, share the Aadhaar number, which was generated pursuant to enrolment of a child below the age of 5 years on the basis of a birth certificate and without collecting the core biometric information, with the Registrar General of India or Chief Registrar for a State appointed under the Registration of Births and Deaths Act, 1969 to prevent duplicate enrolment on the basis of the same birth certificate.
